Terms of Service
In one sentence: Dreamerie is a sleep-audio app you use at your own discretion, it plays podcasts made by other people, and it is not a medical device.
The agreement
Dreamerie is licensed to you, not sold. Your license is governed by Apple's Standard End User License Agreement, which covers installation, permitted use, and termination. These terms add the things that are specific to Dreamerie. Where the two disagree, these terms apply to the Dreamerie service and Apple's agreement applies to the license.
By using the app you accept both. If you do not accept them, delete the app.
Dreamerie is not a medical device
Dreamerie plays audio to help you fall asleep. It does not diagnose, treat, cure, or prevent any condition, and nothing in it is medical advice.
If you turn on health features, the app reads vitals from Apple Health; on your device it learns when you tend to fall asleep, so the Auto sleep timer can end audio at the right time. Those readings come from your Apple Watch and iPhone, they are not clinical measurements, and we do not check them for signs of illness. Do not use Dreamerie to monitor a health condition, and do not rely on it to alert you to anything. If you are worried about your sleep or your health, talk to a doctor.

Podcasts and other people's content
Most of what you hear in Dreamerie is made by other people. We find podcasts through publicly available RSS feeds and play them from the publisher's own servers. We do not host that audio, we do not edit it, and we do not remove or replace the advertising inside it. Because this is a sleep app, we do adjust playback loudness so shows play at a consistent, sleep-friendly volume, the way a volume control does. The content itself plays as the publisher published it.
That content belongs to its creators and is subject to their own terms. We do not review every episode, we make no promise about what is in it, and we are not responsible for it. Podcast catalogs change without notice, so a show you like can disappear from Dreamerie because the publisher changed or withdrew the feed.
Some audio in Dreamerie is ours, including our own shows and the background beds. That stays ours. You can listen to it in the app. You cannot copy it, redistribute it, or use it in something else.
If you publish a podcast and want it removed from Dreamerie, email privacy@dreamerie.app and we will take it out.
Using the app
Use Dreamerie for its intended purpose. Do not try to break into it, overload it, scrape it, resell access to it, or use it to infringe anyone's rights. We can suspend access that is doing any of those things.
This is early software
Dreamerie is in testing. It is provided as is. We do not promise it will always be available, that playback will never fail, or that your data will never be lost, and we may change or discontinue features, or the whole service, at any time.
To the extent the law allows, we are not liable for indirect or consequential losses arising from your use of the app. Nothing here limits liability that cannot be limited by law, and some places do not allow certain exclusions, in which case those do not apply to you.
Age
Dreamerie is rated 13+ on the App Store. That rating is there because you can search and play podcasts from public directories that we do not individually screen. We choose our own library carefully, but a third-party feed can change at any time and we cannot guarantee what is inside every episode. If you are under 13, do not use Dreamerie.
Changes to these terms
If we change these terms in a material way, we will update the date at the top. Continuing to use the app after that means you accept the change.
